These terms are written for Kinovo's current early access product and public website.
1. About these terms
These terms apply when you visit the Kinovo website, create an account, accept an invite, contact support or use a Kinovo care-team workspace.
By using Kinovo, you agree to use the service responsibly and only for lawful care-team coordination purposes.
2. What Kinovo is
Kinovo is a private shared care-team workspace for current care protocols, goals, tasks, documents, team visibility, focused messages and updates.
Kinovo is not a medical record, clinical treatment system, emergency service, NDIS decision maker, legal adviser, plan manager, payroll tool, rostering system or provider operating system.
3. Accounts and access
You are responsible for keeping your login details secure and for making sure information you add is accurate, relevant and appropriate for the care team.
Team leaders control who is invited into a workspace and should only invite people who have a legitimate reason to access that workspace.
If you accept an invite, you must only access and use workspace information for the agreed care-team coordination purpose.
4. Care-team information and confidentiality
Care-team workspaces may contain sensitive disability, health, care, support, family, therapy, NDIS, safety or routine information.
You must not copy, disclose, download, screenshot, forward or use workspace information outside the care-team purpose unless you are authorised to do so.
Kinovo may require users to accept a confidentiality agreement before accessing a workspace.
5. User content
You retain responsibility for the content you add to Kinovo, including messages, updates, goals, tasks, documents, comments and profile information.
Do not upload content that is unlawful, misleading, harmful, abusive, irrelevant, confidential to another person without permission, or outside your authority to share.
You give Kinovo permission to store, process, display and transmit your content as needed to provide the service.
6. No professional advice
Kinovo does not provide medical, clinical, legal, financial, NDIS, safeguarding or emergency advice.
Information in a workspace is added by users. Care decisions should be made by the appropriate participant, nominee, family member, professional, provider or authority.
For urgent safety, health or emergency issues, contact the appropriate emergency, health, safeguarding or service provider directly.
7. Acceptable use
You must not attempt to access workspaces you are not invited to, bypass permissions, scrape data, interfere with the service, upload malware, misuse support channels or use Kinovo to harass, spam or harm others.
We may suspend or remove access if we believe an account, workspace or user activity creates security, privacy, legal or operational risk.
8. Availability and changes
Kinovo is in an early access and alpha-stage product period. Features may change, move, be renamed, be limited or be removed as the product improves.
We aim to keep the service reliable, but we do not guarantee uninterrupted access or that every feature will always be available.
9. Privacy
Kinovo handles personal information according to its Privacy Statement.
You should read the Privacy Statement before adding personal or sensitive care-team information to a workspace.
10. Access, archiving and deletion
Removing or leaving a care team ends access to that workspace but does not erase shared workspace history or close the person's Kinovo account.
Archiving keeps an authorised read-only record and can be reversed. Scheduled document, account or workspace deletion ends normal access immediately, has a 30-day cancellation period and is only described as complete after Kinovo verifies live Storage and database cleanup.
Some minimal non-content security and lifecycle audit records may be retained for a defined period. Older disaster-recovery backups may retain data beyond ordinary use until they age out, and legal or security obligations may require an authorised, audited hold.
Closing a Kinovo account does not remove records that other workspace members need as shared history. Personal profile details are removed or de-identified and historical contributions use a neutral former-member attribution.
Providers and professionals remain responsible for keeping any statutory, clinical, incident, safeguarding or professional records required outside Kinovo.
11. Intellectual property and feedback
Kinovo owns the product, website, software, design, branding and related materials, except for user content and third-party materials.
If you provide product feedback, suggestions or ideas, Kinovo may use them to improve the service without owing compensation.
12. Liability
To the extent permitted by law, Kinovo is not liable for decisions made from user-provided information, user misuse, unauthorised sharing by users, third-party services, loss of data outside our control or indirect loss.
Nothing in these terms excludes rights or guarantees that cannot be excluded under Australian law.
